GPA on behalf of the Government of the Hong Kong Special Administrative Region of the People’s Republic of China invites quotation from all the interested licensed estate agents (hereinafter referred to as “the bidders”) for rendering estate agency services for leasing out surplus Government quarters.

The bidders shall read the Quotation Notice, Quotation Form, the Form of Estate Agency Agreement and all the following information carefully before submitting a quotation.

|Submission of Quotations||The bidders should note that the quotations MUST be :
(a) made in the Quotation Form accompanied by documents in accordance with Paragraphs (6) and (7)(i) of the Quotation Notice;
(b) enclosed in a sealed envelope addressed to and clearly marked on the envelope: “The Quotation Opening Team, Government Property Agency - Quotation for rendering Estate Agency Services for Leasing Out Surplus Government Quarters (Quotation Reference No.: GPA ADD EA/2023”); and;
(c) placed in the Government Property Agency Quotation Box placed at the Ground Floor Lobby, South Tower, West Kowloon Government Offices, No. 11 Hoi Ting Road, Yau Ma Tei, Kowloon, Hong Kong.

(a) GPA is not bound to accept the lowest quotation or any quotation submitted and reserves the right to negotiate with any bidder on its quotation and/or the terms and conditions of the contract. GPA shall have the right to appoint more than one Agent to act as his/her non-exclusive estate agent for leasing any of the properties listed in Annex A to the Form of Agreement.
(b) It is hereby specifically declared by the Government that any statement, whether oral or written, made and any action taken by any Government officer in response to any enquiry made by a prospective bidder shall be for guidance and reference purposes only. Any such statement shall not be deemed to form part of this Quotation Notice and any such statement or action shall not and shall not be deemed to amplify, alter, negate, waive or otherwise vary any of the terms and conditions as set out in this Quotation Notice, the Quotation Form or the Form of Agreement.
(c) Details of the award of the successful bidders will be published on this website. GPA reserves the right to announce the quotation result without the need to seek the prior agreement of the successful bidders.
(d) Any information or other communications from GPA to the bidders shall be deemed to be received (i) if sent by post, the next business day in Hong Kong immediately after the date of despatch (Hong Kong time); and (ii) if sent by fax or email, when despatched, regardless of whether the bidders have actually received such information or communications (as the case may be).
(e) GPA shall have the absolute right to withdraw this invitation for quotation or cancel this quotation exercise for whatever reasons whether before or after the closing of the quotation. Bidders shall not be entitled to claim any costs, expenses, compensation, losses or damages whatsoever from the Government in connection with the preparation and submission of quotation or the withdrawal of this invitation for quotation or cancellation of this quotation exercise.
(f) All quotations submitted shall remain valid for 90 days from the Closing Date of the quotation and shall remain binding upon the bidders and may be accepted by GPA at any time up to the expiry of the said validity period. GPA will only consider and assess all quotations submitted which comply with all the terms and conditions of the Quotation Notice.
|Bribery Ordinance||A bidder shall not and shall ensure that its partners/directors, employees and agents shall not offer, solicit or accept any advantages as defined in the Prevention of Bribery Ordinance (Cap. 201) in connection with this quotation exercise. Any breach of or non-compliance with such requirement shall, without affecting the bidder’s liability for such breach of non-compliance, invalidate its offer without entitling the bidder to any compensation, in which case any acceptance shall be null and void. Bidders’ attention are also drawn to Clause 12(d) of the Form of Agreement under which the Agreement may be terminated if the Agent or any of its partners/directors, employees or agents shall be found to have been convicted of an offence under the said Ordinance in connection with the Agreement. A bidder is advised, if its quotation is accepted, to issue a code of conduct for its staff setting out the probity requirements in detail and it shall also caution its partners/directors, employees and agents against offering, soliciting or accepting any excessive entertainment for inducements which could impair its impartiality in relation to the Estate Agency Services.|
|Privacy of Personal Data||
Purpose of Collection: The personal data provided in connection with this application will be used by GPA for communication relating to quotation matter.
Transfer of Data: The personal data you provide in connection with this application may be disclosed to other Government departments for the purpose of consideration of other tenders or quotations by the Government at any time.
Access of Personal Data: The bidders have the right of access and correction with respect to personal data as provided for in Sections 18 and 22, and Principle 6 of Schedule 1 of the Personal Data (Privacy) Ordinance (Cap.486). The right of access includes the right to obtain a copy of the personal data supplied by and belonging to the relevant bidders.
|Disclaimer||(a) The list(s) of estate agents (hereinafter referred to as "List") maintained by GPA is intended for mailing purposes (where applicable) only. None of the List or GPA's notifications of quotation invitation for rendering estate agency services (hereinafter referred to as "Notifications") shall give rise to any right or expectation on the part of the bidders in relation to any List or any obligation on the part of GPA. The Agency makes no statement, representation or warranty (express or implied) to the bidders that the Notifications or any of them will be uninterrupted, timely, secure, or error free.
(b) GPA shall not in any event be liable to any bidders for any loss or damage whatsoever arising out of or in relation to any failure or delay in receiving any Notifications (whether transmitted by electronic means or otherwise) or removal of any bidders from any List at any point of time, including but not limited to direct, indirect, special, incidental or consequential damages, damages for loss of profits, business interruption, loss of business information, or other pecuniary loss, even if GPA has been advised of the possibility of such loss or damage, whether in contract or tort, or on any other legal or equitable grounds.
(c) GPA and his respective officers, employees and advisors give no warranty or representation, be it expressed or implied, as to the accuracy, adequacy or completeness of the information or data contained on this website.
(d) A Chinese translation is provided on this website. In the event of any doubt or dispute in the interpretation of the information in this website, GPA’s intention as expressed in the English version shall prevail.
